Clear terms, just like our chocolate: honest and with no hidden ingredients. These terms apply to every order placed via chocotale.be.
Article 1 – Who we are
Chocotale is a brand of Chocotale Group BV, Nationalestraat 86, 2000 Antwerpen, ondernemingsnummer 1016.391.833, BTW BE 1016.391.833. Email: contact@chocotale.be. These terms apply to every order via chocotale.be. By placing an order the customer expressly accepts these terms, to the exclusion of their own.
Article 2 – Prices
All prices are in euro and include VAT. Any delivery or administrative costs are stated separately before the order is confirmed. Obvious pricing errors are not binding on us.
Article 3 – Offer
Our offer applies while stocks last and may change at any time. We compile the catalogue with the greatest care but are not liable for material or typographical errors. Questions about a product? Email us first at contact@chocotale.be.
Article 4 – Placing an order
The customer adds products to the cart, enters their details, sees the total including shipping, accepts these terms and the privacy policy, and selects a payment method. The contract is formed once payment is confirmed. We may refuse an order for good cause.
Article 5 – Payment
Payments are processed securely via our payment partner Mollie (including Bancontact, card and other common methods). The order is processed once payment is received.
Article 6 – Delivery
We deliver via DPD to Belgium. Delivery times are indicative; a delay gives no right to compensation or cancellation. Risk passes to the customer on delivery. Report visible damage or a defect as soon as possible, and within 48 hours of receipt at the latest, at contact@chocotale.be.
Article 7 – Right of withdrawal and the food exception
As a consumer you normally have 14 days to withdraw from an online purchase. Important: our chocolate and related food products are perishable goods and sealed foodstuffs. Under Article VI.53 of the Belgian Code of Economic Law, the right of withdrawal does not apply to these once delivered, for reasons of health and hygiene. For non-perishable items (e.g. gift packaging or merchandise) the 14-day right of withdrawal does apply; contact us at contact@chocotale.be.
Article 8 – Warranty and conformity
The customer is entitled to products that conform to the order. Food is delivered with a correct best-before date; store the products as instructed. Report conformity complaints as soon as possible after receipt.
Article 9 – Complaints and disputes
Complaints can be sent to contact@chocotale.be. We are happy to find a solution together. You may also use the European ODR platform (ec.europa.eu/consumers/odr) and the Belgian Consumer Mediation Service.
Article 10 – Liability and force majeure
Our liability is limited to the amount of the order concerned, save for intent or gross negligence. In the event of force majeure (including transport disruptions, exceptional weather) our obligations are suspended.
Article 11 – Intellectual property
All trademarks, including Black Sand(R) and Angel Hair(R), logos, texts and images are protected and owned by Chocotale Group BV, Nationalestraat 86, 2000 Antwerpen, ondernemingsnummer 1016.391.833, BTW BE 1016.391.833 or its licensors. Use without permission is prohibited.
Article 12 – Governing law
These terms are governed by Belgian law. Disputes fall within the jurisdiction of the courts of the judicial district of Antwerp.
